Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ProTrader Scans website at protraderscans.com, the trading tools application at app.protraderscans.com, and all related products, features and services (together, the “Service”) operated by ProTrader Scans (“ProTrader Scans”, “we”, “us” or “our”). By creating an account, starting a trial, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide to us is accurate and complete.

2. Accounts and Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us promptly of any unauthorised use of your account.
• You may not share, sell, or transfer your account or access to the Service to any other person.

3. Subscriptions, Trials and Billing

• The Service is offered on a subscription basis across the plans and pricing published on our website. Prices are shown in the currency indicated at checkout and may exclude applicable taxes.
• Where a free trial is offered, it lasts for the stated trial period. Unless you cancel before the trial ends, your subscription will automatically begin and the applicable fee will be charged to your payment method.
• Subscriptions renew automatically at the end of each billing cycle (monthly or as otherwise stated) until cancelled.
• You authorise us and our payment processor to charge your payment method for all fees due. Payments are processed securely by our third-party payment provider; we do not store full card details.
• We may change our pricing from time to time. Any price change will apply to your next billing cycle and, where required, we will give you reasonable prior notice.

4. Cancellations and Refunds

• You may cancel your subscription at any time from your account settings or by contacting us. Cancellation stops future renewals; you will retain access until the end of your current paid period.
• Except where required by law (including the Australian Consumer Law), fees already paid are generally non-refundable and partial billing periods are not refunded.
• Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.

5. Nature of the Service — No Financial Advice

• Scans, signals, charts, indicators, watchlists and other outputs are provided for general informational and educational purposes only and do not take into account your personal objectives, financial situation or needs.
• Market data may be delayed and is provided “as is”. You should not rely on the Service for time-critical trading decisions and should independently verify any data before acting on it.
• Trading and investing involve substantial risk, including the loss of capital. Past performance is not indicative of future results. You are solely responsible for your own trading and investment decisions and should seek advice from a licensed financial adviser where appropriate.

6. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in breach of any applicable law or regulation;
• copy, scrape, resell, redistribute or commercially exploit any data, output or content from the Service except as expressly permitted;
• reverse engineer, decompile, or attempt to extract the source code of the Service;
• use automated means to access the Service in a way that imposes an unreasonable load on our infrastructure, or attempt to gain unauthorised access to any part of the Service;
• interfere with or disrupt the integrity or performance of the Service.

7. Intellectual Property

The Service, including all software, scans, algorithms, text, graphics, logos and design, is owned by or licensed to ProTrader Scans and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business use in accordance with these Terms. All rights not expressly granted are reserved.

8. Third-Party Services and Data

The Service relies on data feeds, market data and infrastructure provided by third parties. We are not responsible for the accuracy, completeness, timeliness or availability of third-party data, or for any third-party websites or services linked from the Service.

9. Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Service at any time, and may impose limits on certain features, with or without notice.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. This clause does not exclude any guarantee that cannot lawfully be excluded under the Australian Consumer Law.

11. Limitation of Liability

To the maximum extent permitted by law, ProTrader Scans and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading losses, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Where our liability cannot be excluded but can be limited, our total aggregate liability to you is limited to the amount you paid us for the Service in the twelve (12) months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless ProTrader Scans from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnity) will survive.

14. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where changes are material, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
